About the Bill
On 27 October 2015, the Minister for Main Roads, Road Safety and Ports and Minister for Energy and Water Supply introduced the Transport Operations (Marine Safety) and Other Legislation Amendment Bill 2015 into the Queensland Parliament. In accordance with Standing Order 131, the Bill was referred to the Utilities, Science and Innovation Committee for detailed consideration.
The policy objective of the Bill is to ensure that there is a seamless interaction between the Commonwealth’s Marine Safety (Domestic Commercial Vessel) National Law Act 2012 (National Law) and Queensland legislation for the regulation of domestic commercial vessels. Queensland legislation that seeks to regulate domestic commercial vessels in relation to registration, licensing and safety matters that the National Law regulates has been of no effect since 1 July 2013. This is because the Commonwealth Act takes precedence over Queensland legislation. The Bill therefore proposes amendments to the Transport Operations (Marine Safety) Act 1994 and other Queensland legislation to recognise the transfer of responsibility for these aspects of domestic commercial vessels regulation to the National Law.
